Agreement to Terms

Welcome to Avril Tours and Lodges. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or booking our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Definitions

For the purposes of these Terms:

  • "We," "Us," "Our" refers to Avril Tours and Lodges
  • "You," "Your" refers to the customer or user of our services
  • "Services" refers to all travel services, tours, accommodations, activities, and related offerings provided by us
  • "Website" refers to our online platform and all associated pages
  • "Booking" refers to any reservation or purchase of our services
  • "Supplier" refers to third-party service providers including hotels, lodges, transport operators, and activity providers

Booking and Payment Terms

Booking Process:

  • All bookings are subject to availability and confirmation
  • A booking is confirmed only upon receipt of payment and written confirmation from us
  • You must provide accurate and complete information when making a booking
  • You are responsible for ensuring all traveler details are correct

Payment Terms:

  • A non-refundable deposit of 30% is required to secure your booking
  • Full payment must be received at least 30 days before travel
  • Bookings within 30 days of travel require immediate full payment
  • All prices are quoted in USD unless otherwise stated
  • We accept credit cards, bank transfers, and mobile money payments
  • Payment processing fees are non-refundable

Price Accuracy:

  • We strive to ensure all prices are accurate, but errors may occur
  • If a pricing error is discovered, we will notify you and offer the option to proceed at the correct price or cancel without penalty
  • Prices are subject to change until booking is confirmed and paid

Travel Documents and Requirements

It is your sole responsibility to ensure you have all necessary travel documents:

  • Valid passport with at least 6 months validity from return date
  • Appropriate visas for Zimbabwe and any transit countries
  • Required vaccinations and health certificates
  • Travel insurance documentation
  • Any other documents required by authorities

We are not responsible for any consequences arising from invalid, incomplete, or missing travel documents. No refunds will be provided if you are denied entry or boarding due to documentation issues.

Health, Safety, and Fitness

Health Requirements:

  • You must disclose any medical conditions that may affect your travel
  • You must obtain necessary vaccinations and medical clearances
  • You should consult your doctor before traveling, especially for adventure activities
  • Pregnant travelers should seek medical advice before booking

Safety Obligations:

  • You must follow all safety instructions provided by guides and staff
  • You must not engage in reckless or dangerous behavior
  • You must respect wildlife and maintain safe distances
  • You must comply with local laws and regulations

Fitness Requirements:

  • Some activities have minimum age, health, or fitness requirements
  • We reserve the right to refuse participation if safety concerns arise
  • No refunds will be provided if you are unable to participate due to health or fitness reasons

Limitation of Liability

Our Role:

Avril Tours and Lodges acts as an agent for various service providers including hotels, transport operators, and activity providers. We arrange services on your behalf but do not own or operate these services.

Limitations:

  • We are not liable for acts, errors, omissions, or negligence of third-party suppliers
  • We are not responsible for delays, cancellations, or changes due to weather, political situations, natural disasters, or force majeure events
  • We are not liable for loss, damage, or theft of personal belongings
  • We are not responsible for personal injury, illness, or death except where caused by our direct negligence
  • Our total liability is limited to the amount paid for your booking

Your Responsibilities:

  • You are responsible for your own safety and the safety of minors in your care
  • You are responsible for your personal belongings
  • You are liable for any damage you cause to property or equipment
  • You must have adequate travel insurance to cover potential risks

Acceptable Conduct

You agree to:

  • Behave respectfully toward staff, guides, other travelers, and local communities
  • Comply with local laws, customs, and regulations
  • Not engage in illegal activities or behavior that endangers others
  • Not cause damage to property, wildlife, or the environment
  • Not be under the influence of drugs or excessive alcohol during activities
  • Follow instructions from guides and staff at all times

Important: We reserve the right to terminate your participation in any service if your behavior is deemed inappropriate, dangerous, or disruptive. No refunds will be provided in such cases, and you may be liable for any additional costs incurred.

Intellectual Property Rights

All content on our website, including text, images, logos, graphics, videos, and software, is the property of Avril Tours and Lodges or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, reproduce, or distribute our content without written permission
  • Use our trademarks, logos, or branding without authorization
  • Modify, reverse engineer, or create derivative works from our content
  • Use our content for commercial purposes without a license

You may view and print content for personal, non-commercial use only.

Photography and Media Release

During your tour, we may take photographs or videos for promotional purposes. By participating in our services, you grant us permission to:

  • Take photographs and videos of you during tours and activities
  • Use these images in our marketing materials, website, and social media
  • Share images with third-party partners for promotional purposes

If you do not wish to be photographed or have your images used, please inform us in writing at the time of booking.

Complaints and Dispute Resolution

During Your Trip:

If you experience any issues during your trip, you must notify us or our local representative immediately. We cannot address complaints or provide remedies for issues not reported during your trip.

After Your Trip:

If you wish to make a complaint after your trip, you must submit it in writing within 30 days of your return. Include:

  • Your booking reference number
  • Detailed description of the issue
  • Supporting evidence (photos, receipts, etc.)
  • Desired resolution

Resolution Process:

  • We will acknowledge your complaint within 5 business days
  • We will investigate and respond within 30 days
  • If you are not satisfied with our response, we will work toward a mutually acceptable resolution

Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters (floods, earthquakes, fires, severe weather)
  • War, terrorism, or civil unrest
  • Government actions, travel restrictions, or border closures
  • Pandemics or health emergencies
  • Strikes or labor disputes
  • Supplier failures or bankruptcies

In such events, we will make reasonable efforts to provide alternative arrangements or refunds where possible, but we are not obligated to do so.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Booking Policy, Cancellation Policy, and Privacy Policy, constitute the entire agreement between you and Avril Tours and Lodges regarding your use of our services.

These Terms supersede any prior agreements, representations, or understandings, whether written or oral.
